APPLICANT REQUESTS THAT:
1. His records be corrected to reflect award of the Joint
Service Commendation Medal (JSCM).
2. His corrected record receive Special Selection Board (SSB)
consideration for the Calendar Year 2009 (CY09) Colonel Central
Selection Board (CSB).
APPLICANT CONTENDS THAT:
He just recently received the JSCM that was awarded to him 2009
from the Special Operations Command-Central (SOCCENT). This
medal should be updated in his records and he should receive SSB
consideration due to the correction of his records.
The applicants complete submission, with attachments, is at
Exhibit A.
STATEMENT OF FACTS:
The applicant is former service member who retired on 1 Jun 10.
The JSCM may be awarded to service members of the Armed Forces
who, while assigned to a joint activity after 1 Jan 63,
distinguished themselves by meritorious achievement or service.
The remaining relevant facts pertaining to this application are
described in the memoranda prepared by the Air Force offices of
primary responsibility (OPR), which are included at Exhibits C
and D.
AIR FORCE EVALUATION:
AFPC/DPSID recommends approving award of the JSCM. The Special
Order is the official source document for verification of award
of the JSCM. The applicants records did not contain a special
order, which is the official source document for verification of
the award; however, he has provided what appears to be an
authentic signed certificate with a Given Under My Hand date of
9 Jan 09, along with the citation, with the official raised
seal, for the inclusive period of 5 Sep 08 through 4 Jan 09.
A complete copy of the AFPC/DPSID evaluation is at Exhibit C.
AFPC/DPSOO recommends approval for SSB consideration, indicating
that while AFPC/DPSID cannot locate a special order verifying
the JSCM was awarded to the applicant, the fact the applicant
has provided what appears to be an authentic signed certificate,
with a Given Under My Hand date of 9 Jan 09, and a citation with
official seal, the citation should be filed in the applicants
officer selection record (OSR), updated on his Officer Selection
Brief (OSB), and his corrected record should be provided SSB
consideration for the P0609D CSB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the
applicant on 21 Jul 14 for review and comment within 30 days
(Exhibit E). As of this date, no response has been received by
this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an injustice. After a thorough
review of the evidence of record and the applicants complete
submission, we agree with the opinions and recommendations of
the Air Force offices of primary responsibility and adopt their
rationale as the basis for our conclusion the applicant has been
the victim of an error or injustice. Therefore, we recommend
that his records be corrected to reflect that he was awarded the
Joint Service Commendation Medal (JSCM) and that his corrected
records receive Special Selection Board (SSB) consideration for
the Calendar Year 2009 (CY09) Colonel Central Selection Board
(CSB). Should the applicant be selected for promotion by the
SSB, the results will be forwarded to the Air Force Board for
Correction of Military Records at the earliest practicable date
so that all necessary and appropriate actions may be completed.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to the APPLICANT be corrected to show that:
a. On 9 January 2009, he was awarded the Joint Service
Commendation Medal for his exceptionally meritorious service
from 5 September 2008 to 4 January 2009.
b. The citation for the Joint Service Commendation Medal
rendered for the period 5 September 2008 to 4 January 2009, be
included in his OSR on 9 January 2009 and updated on his Officer
Selection Brief for the Calendar Year 2009D (CY09D) Colonel
Central Selection Board.
c. It is further directed that his corrected records be
provided Special Selection Board (SSB) consideration for the
CY09D Colonel Central Selection Board (CSB). If the applicant
is recommended for promotion by the SSB, the Air Force Board for
Correction of Military Records be advised of that recommendation
at the earliest practicable date so that all necessary and
appropriate actions may be completed. If he is not recommended
for promotion by the SSB, the office of primary responsibility
advise him accordingly.

Additionally, the applicant filed another request to the ERAB on 19 October 2010 requesting the CY2009C PRF be removed and he be provided SSB consideration. The new PRF resurrects the same performance comments from the voided OPR and resulted in the same effect as if the original OPR and PRF were never removed.
